In the event of any conflict between these Terms and a signed engagement agreement, the engagement agreement controls.

GrowthRx does not access, receive, transmit, store, or process Protected Health Information (PHI) as defined under the Health Insurance Portability and Accountability Act (HIPAA) through this website or in the ordinary course of its services.
Dental practice owners are HIPAA-covered entities and remain solely responsible for their own HIPAA compliance, including any obligations relating to their business associates. If a specific GrowthRx engagement requires access to PHI — which is not standard — a Business Associate Agreement (BAA) must be executed in writing before any such access occurs. These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. For clients in the United States, any dispute arising from a service engagement shall be resolved per the dispute resolution clause in the applicable written engagement agreement, which may specify a different jurisdiction or arbitration venue.
For website-related disputes not covered by an engagement agreement, the parties agree to first attempt informal resolution by emailing drsirish@getgrowthrx.com and allowing 30 days for good-faith resolution before initiating any formal proceeding. If informal resolution fails, disputes shall be resolved by binding arbitration under the rules of an internationally recognized arbitration body, with proceedings conducted in English.
GrowthRx shall not be liable for any delay or failure to perform obligations under these Terms or any engagement agreement where such delay or failure results from circumstances beyond GrowthRx's reasonable control, including but not limited to natural disasters, internet or infrastructure outages, government actions, or pandemics. In such events, GrowthRx will notify you promptly and make reasonable efforts to resume performance.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
For website use, these Terms constitute the entire agreement between you and GrowthRx with respect to your use of the Site. For service engagements, the signed engagement agreement together with these Terms constitutes the entire agreement between the parties, superseding any prior discussions, representations, or agreements.
GrowthRx reserves the right to update these Terms at any time. The "effective date" at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We will note material changes at the top of this page.
